1. General provisions

1.1. These Terms of Service (hereinafter referred to as the “Rules”) are a legally binding document that establishes the mutual rights, obligations and responsibilities of the Buyer and the online store bratelaz.com (hereinafter referred to as the “Seller”), the conditions of purchase and payment for goods, the procedure for delivery and return when the Buyer purchases the goods in the Seller's e-shop (hereinafter referred to as the "e-shop") and confirms them (after reading the Rules and checking the box "I have read and agree to the Terms and Conditions").

1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by law. Each time you want to shop in the e-shop, the Buyer will have to re-agree to these Rules.

1.3. E-shop is sold throughout the European Union.


2. Conclusion of a purchase and sale agreement

2.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the product (s) to be purchased and formed a shopping cart, clicks "Confirm the order".

2.2. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the e-shop database.

2.3. Taking into account Article 8 of the Law on Electronic Signature of the Republic of Lithuania. 3 d. the Buyer agrees with the Seller that the confirmation of the Buyer's actions in the e-shop with the data of connection to the e-shop (in the name of identification) has Article 8 of the Law on Electronic Signature. 1 d. established legal force of an electronic signature (i.e. has the same legal force as a signature in written documents and is permissible as a means of proof in court).


3. Buyer's rights

3.1. The Buyer has the right to purchase goods in the e-shop in accordance with the procedure established by these Rules and the legal acts of the Republic of Lithuania.

3.2. You have the right to buy in the e-shop:

3.2.1. persons who have reached the age of majority and whose capacity is not restricted by court order;

3.2.2. legal entities.

3.3. The Buyer has the right to withdraw from the contract of purchase and sale of goods with the Seller by notifying the Seller in writing within 7 working days from the date of delivery of the goods. August 17 By the order of the Minister of Economy of the Republic of Lithuania No. 258 "On the approval of rules for the sale of goods and the provision of services by means of contracts".

3.4. The returned item must be fully completed. The Buyer is responsible for the complete assembly and packaging of the item. If the item is not fully assembled and properly packaged, the Seller or its representative will not accept the item for return.


4. Obligations of the Buyer

4.1. The Buyer must pay for the goods and accept them in accordance with these Rules.

4.2. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller about it by the means of communication specified in the "Contacts" section of the online store.

4.3. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.

4.4. The Buyer undertakes to comply with these Terms and not to violate the legal acts of the Republic of Lithuania.


5. Seller's Rights

5.1. The seller has the right to set the minimum size of the shopping cart at its own discretion, i. the minimum amount at which the Buyer's order will be processed. The amount of this amount is visible when viewing the shopping cart.

5.2. If the Buyer tries to compromise the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.

5.3. In the event of significant circumstances, the Seller may temporarily or permanently terminate the operation of the e-shop without prior notice to the Buyer.

5.4. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen the prepayment method, does not pay for the goods within 1 (one) business day.


6. Responsibilities of the Seller

6.1. The Seller undertakes to make available to the Buyer the services provided by the e-store in accordance with the procedure established in these Rules.

6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him.

6.3. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to return the money paid to the Buyer within 5 (five) business days, if a prepayment has been made.


7. Prices of goods, payment procedure and terms

7.1. The prices of the goods in the e-shop and the formed order are indicated in euros and are final.

7.2. The Buyer pays for the goods by bank transfer and transfers the amount specified in the order to the Seller's bank account or other payment methods valid at that time, which can be found in the e-shop information section "Payment methods".

7.3. Payment 7.2. by the bank transfer provided for in paragraph, the Buyer undertakes to pay within 24 hours. Only upon receipt of the notice that the Buyer has paid for the goods, the Seller shall start to form the consignment of goods and from that date the term for delivery of the goods shall begin to run on working days.

7.4. When the Buyer pays for the goods by the bank transfer payment method and concludes an agreement with the Seller (by clicking on the link "Confirm the order"), a prepayment invoice is sent to the Buyer's e-mail, which the buyer can print out.

7.5. For orders with a value of 150.00 Eur or more, full or partial prepayment may be required. This condition has been introduced for goods not taken back by buyers.


8. Delivery of goods

8.1. When ordering the goods, the buyer undertakes to indicate the place of delivery of the goods.

8.2. The goods are delivered by the Seller or his authorized representative.

8.3. Delivery prices are indicated in the information section "Delivery of goods" and depend on the chosen delivery method.

8.3.1. Delivery of the consignment to the Curonian Spit is coordinated by a separate agreement.

8.4. The Seller undertakes to send the goods to the Buyer within the working days mentioned in the description of the individual goods. When ordering several goods with different dispatch terms, the dispatch of the goods is calculated according to the longest of them. If the payment method is selected by bank transfer, the delivery time is calculated taking into account 7.3. point.

8.5. Rules 8.4. The terms mentioned in point 1 shall not apply in cases when the required goods are not in the Seller's warehouse and the Buyer is informed about the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases the dispatch / delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and coordinate the dispatch / delivery of the goods.

8.6. The buyer undertakes to accept the goods himself. In the event that he is unable to accept the goods himself and the goods are delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make claims to the Seller regarding delivery of the goods to the wrong entity.

8.7. In all cases, the Seller shall be released from liability for violation of the terms of dispatch of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.


9. Return and exchange of goods

9.1. Return and exchange of goods is carried out in accordance with the Civil Code of the Republic of Lithuania.

9.2. The Buyer may exercise the right to return and exchange the goods within 14 (fourteen) working days from the date of delivery of the goods to him, informing the Seller about the contacts indicated in the information section "Contacts".

9.3. When returning the goods to the buyer, the following conditions must be met:

9.3.1. the returned goods must be in the original neat packaging;

9.3.2. the goods must be undamaged by the Buyer;

9.3.3. the product must not have lost its commercial appearance (undamaged label, peel-off protective film, etc.);

9.3.4. the returned goods must be in the same configuration as received by the Buyer;

9.3.5. when returning the goods, it is necessary to present the document of its acquisition and other documents related to the purchase of the goods.

9.4. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article. For more information about returns, see the "Returns" section.


10. Privacy Policy

10.1. The Seller respects the privacy of each individual and is committed to protecting it. The Seller shall process the personal data provided by the Buyer on the Website in accordance with the requirements established by the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts of the Republic of Lithuania regulating the processing and protection of such data. The Seller undertakes not to disclose the Buyer's data to third parties, except in cases when required by the laws of the Republic of Lithuania.


11. Liability

11.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences.

11.2. The buyer is responsible for the actions performed in the e-shop.

11.3. The buyer is responsible for transferring his login details to third parties. If the provided services are used by a third party who has logged in to the e-shop with the Buyer's login details, the Seller considers this person to be the Buyer.

11.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, despite the recommendations of the Seller and its obligations, did not read these Rules, even though he was given such an opportunity.

11.5. The Seller is not responsible for the information provided on the websites of other companies, even if the Buyer accesses these websites via links in the Seller's e-shop.

11.6. In the event of damage, the guilty party compensates the other party for the direct damage.


12. Final provisions

12.1. The Seller shall send all notices to the e-mail address provided in the Buyer's registration form and, in certain cases, to the telephone number.

12.2. The Buyer shall send all notices and questions to the Seller's online store by the means of communication specified in the "Contacts" section.

12.3. All disputes arising out of the application of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
